1. Introduction
These Terms of Service ("Terms") govern your use of the TroCymru platform and website operated by TroCymru Ltd (Company No. 16844265) ("we", "us", "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Services
TroCymru provides a circular economy tracking platform for the construction sector, including QR-based material tracking, carbon calculation, chain-of-custody evidence generation, and ESG reporting. Our services are provided on a subscription or project basis as detailed in your service agreement.
3. Accounts
Access to certain features requires an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.
4. Acceptable Use
When using our platform, you agree not to:
- Submit false or misleading material capture data
- Tamper with QR codes, GPS data, or photographic evidence
- Use the platform for any purpose other than legitimate waste tracking and reporting
- Attempt to gain unauthorised access to other users' data or system infrastructure
- Reproduce, distribute, or commercially exploit the platform without our written consent
5. Data Accuracy
You are responsible for the accuracy of data entered into the platform, including material weights, types, and photographic evidence. TroCymru provides carbon calculations based on published WRAP/ICE factors and the data you supply. We do not independently verify the physical accuracy of material weights or conditions at the point of capture.
6. Intellectual Property
The TroCymru platform, including its design, code, carbon calculation methodology, and branding, is the intellectual property of TroCymru Ltd. Your service agreement grants you a limited, non-exclusive licence to use the platform for its intended purpose. Data you submit remains your property; we are granted a licence to process it for service delivery.
7. Pilot Programmes
Pilot programmes are subject to a separate pilot agreement that defines scope, duration, deliverables, and pricing. The pilot agreement takes precedence over these general Terms where there is any conflict. Pilot enquiries submitted through our website are not binding commitments.
8. Limitation of Liability
To the maximum extent permitted by law, TroCymru Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability for any claim related to the services shall not exceed the fees paid by you in the 12 months preceding the claim. Nothing in these Terms excludes liability for death, personal injury caused by negligence, or fraud.
9. Regulatory Compliance
TroCymru is registered with Natural Resources Wales as a Waste Carrier/Broker/Dealer (CBDU033191). While our platform supports compliance reporting, it is your responsibility to ensure your organisation meets all applicable environmental regulations. TroCymru reports and evidence packs are tools to support compliance, not substitutes for independent regulatory advice.
10. Termination
Either party may terminate the service agreement with 30 days' written notice. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, we will provide a reasonable period for you to export your data.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated with at least 30 days' notice. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
